Qusetion about patch ;)

Hi,
    several months ago i was here subscribed and asked about why on my HP
Nx9105 i cannot see mi wifi or tv card in lspci (it means the kernel
modules for the cards didnt't worked too so did not the cards ;)),
Then i answered myself that it is because of this patch

And I would like to ask why it is not in kernel (my last for now
2.6.12.5 and i still had to patch the kernel when it is know problem
from 2.6.7 kernel) ? It is that nobody bothers about it or is some
security problem that cannot be in stable kenrel or what ?
